Brussels - Snowy Sidewalk: Who is Responsible for Clearing it?
Most municipalities in Wallonia and Brussels require residents—whether owners or tenants—to ensure the cleanliness and safety of the sidewalks in front of their homes.
These regulations specifically state that local residents must clear snow and spread salt on their sidewalks during winter.
In practice, this obligation falls on the occupant of the property.
Failure to comply with these obligations may result in an administrative fine imposed by the municipality, which can reach up to €350 or more in the event of repeated offences.
Furthermore, if a pedestrian slips on a sidewalk that has not been cleared of snow, the civil liability of the resident may be engaged if it is proven that this negligence caused the fall.
The resident may then be required to pay compensation to the injured pedestrian.
